JUDGE'S EX OFFICIO AUTHORITY ON THE CASE OF TALAK -DIVORCE; MAQASID SHARIˋAH PERSPECTIVE

This article is the result of library research. research included in normative legal discussion aims to explain basis Islamic law on judge’s ex officio authority Nganjuk Religioun Court judges judgement talak-divorce cases, number: 2033/Pdt.G/2017/PA.Ngj. Researcher analysis data by maqāsid sharī'ah theory. The findings this study are that use efficio rights which does not follow civil procedural has a strong basis. argument based shāṭibi benefits guarded judge accordance with al Dharūriyyāt category, especially hifz nafs, namely maintenance soul. benefit Dharāriyyāt shown through first wife proven be given her husband before divorce decided, so considers authority; second, maintaining ex-wife after even though (the respondent) did file reconvention trial.
